These Terms of Service ("Terms") govern your use of our website at utubator.com and our 24/7 YouTube streaming platform service (the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

Service Description
Utubator provides a platform for 24/7 live streaming to YouTube. Our Service allows you to:

- Connect your YouTube channel via OAuth
- Create and manage continuous live streams
- Monitor stream status and analytics
YouTube API Services
Our Service uses the YouTube API Services to enable streaming functionality. By using the Service, you are agreeing to be bound by the YouTube Terms of Service. You also agree to comply with:
You are responsible for ensuring your use of our Service complies with YouTube's Community Guidelines and Terms of Service. Violation of YouTube's policies may result in termination of your streams and/or your YouTube channel.
User Content
You retain ownership of all content you upload to our Service. By uploading content, you grant us a limited license to store, process, and stream your content as necessary to provide the Service.
You represent and warrant that:
- You own or have the necessary rights to the content
- Your content does not infringe any third-party rights
- Your content complies with all applicable laws
- You have all necessary rights for any music or audio content, including licenses from artists, record labels, publishers, and performing rights organizations (PROs such as ASCAP, BMI, SESAC)
Music licensing is your responsibility. Streaming copyrighted music without proper licenses may result in copyright strikes on your YouTube channel.
Acceptable Use
You agree not to use our Service to:
- Stream content that violates YouTube's Community Guidelines
- Infringe intellectual property rights
- Transmit illegal, harmful, or offensive content
- Attempt to circumvent security measures
- Interfere with or disrupt the Service
- Use the Service for unauthorized commercial purposes
- Violate any applicable laws or regulations
Prohibited Content
The following types of content are strictly prohibited on our Service:
- Pornographic, sexually explicit, or adult content
- Extremist, terrorist, or hate speech content
- Content promoting violence or harassment
- Gambling, casino, or betting content (unless properly licensed)
- Content that violates YouTube Community Guidelines
- Copyright-infringing content without proper authorization
- Spam, scams, or misleading content
- Content that exploits minors in any way
We reserve the right to remove any content that violates these restrictions and to terminate accounts of repeat offenders without refund.

Users are solely responsible for ensuring their uploaded content does not infringe third-party intellectual property rights.
Payment and Subscriptions
Some features of our Service require a paid subscription. By subscribing, you agree to:
- Pay all applicable fees
- Provide accurate billing information
- Accept automatic renewal unless cancelled
Refund Policy: You may request a refund within 14 days of your initial subscription purchase, provided you have not initiated any streaming activity. Refunds are not available after streaming has been used or after the 14-day period. Refund requests are evaluated individually and transaction processing fees may be deducted from refund amounts.
Intellectual Property
The Service and its original content (excluding user content), features, and functionality are owned by Utubator and are protected by copyright, trademark, and other intellectual property laws.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
We are not responsible for any actions taken by YouTube, including stream termination or channel suspension resulting from your content or streaming activities.
Our Service depends on YouTube and Google services for its core functionality. We are not responsible for service interruptions, policy changes, API modifications, or actions taken by YouTube or Google, including but not limited to: stream termination, channel suspension, monetization changes, API access revocation, or any other changes to their platforms or policies.
We do not guarantee any specific uptime, stream quality, or availability of third-party services.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, UTUBATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
Indemnification
You agree to indemnify and hold harmless Utubator and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable.
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, United States, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the Service shall be exclusively resolved in the state or federal courts located in South Carolina, United States. You consent to the personal jurisdiction and venue of such courts.
